Terms of Use

These Terms of Use ("Terms") govern your use of the DotsCard mobile application (the "App") developed by Emile Labs ("we", "our", or "us"). By downloading or using the App, you agree to these Terms.

1. Acceptance of Terms

By accessing or using DotsCard, you agree to be bound by these Terms. If you do not agree, do not use the App. If you are a parent or guardian, you are responsible for your child's use of the App.

2. Description of Service

DotsCard is an educational App designed for children aged 5-9 that builds number sense through dot-pattern recognition (subitising). The App offers:

Free features: Daily Challenge, Beginner and Easy difficulty tiers, up to 3 profiles
Premium features: All difficulty tiers, all layout modes, spaced repetition training, detailed statistics, up to 50 dots (available via subscription)
Family features: All Premium features for up to 6 profiles with Family Sharing

3. Subscriptions and Payments

3.1 Subscription Plans

Premium Monthly: AUD $2.99 per month
Premium Annual: AUD $24.99 per year
Family Annual: AUD $29.99 per year (supports Family Sharing)

Prices may vary by region based on Apple's pricing tiers.

3.2 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

3.3 Managing Subscriptions

You can manage or cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions.

3.4 Free Trial

If a free trial is offered, any unused portion of the trial period will be forfeited when you purchase a subscription.

3.5 Refunds

All purchases are processed by Apple. Refund requests should be directed to Apple Support.

4. User Accounts and Profiles

The App uses local device profiles. No account registration, email, or personal information is required.
Profiles consist of a first name and emoji avatar chosen by the user.
Users are responsible for managing their own profiles on shared devices.

5. Acceptable Use

You agree not to:

Reverse engineer, decompile, or disassemble the App
Attempt to bypass subscription or entitlement controls
Use the App for any unlawful purpose
Interfere with the Online Battle multiplayer service

6. Intellectual Property

All content in the App, including but not limited to design, graphics, text, and code, is the property of Emile Labs and is protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the App without our written consent.

7. Online Features

The Online Battle feature allows real-time multiplayer gameplay. By using this feature:

You agree to use appropriate display names
You understand that game session data is temporarily processed by Firebase
We reserve the right to disable access to online features for misuse

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Emile Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia.
